By creating an account or using Chamuka DrawIt, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

You must be at least 13 years old to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of Service

Chamuka DrawIt is an AI-powered design platform that enables users to:

• Create illustrations, infographics, UI designs, presentations, and technical diagrams
• Generate visual content using artificial intelligence based on text prompts
• Collaborate in real-time with team members on shared design projects
• Export designs in multiple formats including PNG, SVG, and native .drawit format
• Share designs publicly through our gallery feature

3. User Accounts

3.1 Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update this information to keep it accurate.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to our Service, users, or third parties.

4. User Content and Intellectual Property

4.1 Your Content

You retain ownership of the designs, prompts, and other content you create using the Service ("User Content"). By using the Service, you grant us a limited license to store, display, and process your User Content as necessary to provide the Service.

4.2 AI-Generated Content

Content generated using our AI features is subject to the following:

• You own the rights to AI-generated designs created from your prompts, subject to any applicable third-party licenses
• AI-generated content should not be used to infringe on existing copyrights, trademarks, or other intellectual property rights
• We make no guarantees about the uniqueness of AI-generated content; similar prompts may produce similar results for different users

4.3 Public Gallery

If you choose to publish designs to the public gallery, you grant other users the right to view your content. You represent that you have the right to share any content you make public.

5. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Create content that infringes on intellectual property rights of others
• Generate deepfakes, misleading content, or content intended to deceive others
• Attempt to circumvent AI safety measures or content moderation systems
• Use the Service to generate content depicting minors in inappropriate contexts
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use automated systems or bots to access the Service without our written permission
• Interfere with or disrupt the integrity or performance of the Service
• Share your account credentials or allow others to access your account

6. Subscription and Payments

6.1 Free Tier

We offer a free tier with limited features and usage. Free tier limitations may change at our discretion.

6.2 Paid Subscriptions

Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed through Stripe. By subscribing, you authorize us to charge your payment method for the subscription fee.

6.3 Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation:

• Your subscription will remain active until the end of the current billing period
• We do not provide prorated refunds for partial billing periods
• After cancellation, your account will revert to the free tier

7. Third-Party Services

Our Service integrates with third-party providers including:

• AI Providers: Google (Gemini), OpenAI, Anthropic, and others for content generation
• Authentication: Clerk for user authentication and identity management
• Payments: Stripe for payment processing
• Hosting: Vercel for application hosting and infrastructure

Your use of these third-party services is subject to their respective terms and privacy policies.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING:

• Merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, error-free, or secure
• The accuracy, reliability, or quality of AI-generated content
• That defects will be corrected or that the Service is free of viruses or other harmful components

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAMUKA LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Chamuka Labs and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
